    Throttling internet usage by IP

    Is there a software solution to do this as I am confused as to how to do this through the modem?

    Either a QoS router like Tomato firmware on a Linksys WRT, or a full router/firewall like pfSense on a small PC. There are many others such as Untangle, Smoothwall, etc.

    Otherwise you have install software on each host to throttle the traffic.

    Does this software run as a service otherwise can it be run from one of the other Windows users who stays logged in?

    any cisco router (not linksys) can do rate limiting per IP even per protocol. Other bandwidth managers worth looking at dbam, bluecoat, packeteer.
