    Personal Injury Claim Against a Store, how much to claim????

    Well a freak accident happened in a store ending in a deep cut on the leg below the knee and resulting in 6 stitches. Cut is aprox 3-4" long which is going to leave a SCAR.

    Rec'd a call from the insurance company of the store asking how much we want$$$$$
    Now I'm not looking to get rich and retire from this but have absolute no clue so I turn to the fabulous world of GEOEXPAT to hear opinions of people I have never meet before Haahaaa

    I am creating a poll so as to get a sense of how much people will really ask

    My only data point is that a lawyer has told me that a fractured shoulder resulting in 6 months recovery, physio etc is worth about $200,000 plus medical expenses. So I guess from that that you might get a few tens of thousands.

    More if you're in a business where scars would be detrimental.

    Otherwise, when you get a fair figure in your head just add the cost of a good piss-up for those who have helped on Geo then make your claim

    Missus, she has a knack for getting hurt

    the cut is on her right leg facing outwards so its visible, near the shins.

    counting the emotional costs could be sky high.... here's a helpful guide from ONC lawyers:

    (2) Non-financial loss compensates you for your pain and loss of enjoyment of
    life.
    In making the award, the court could take into account the following:-
    the degree of pain inflicted upon you by the accident;
    the loss of enjoyment of life as a result of the accident, e.g., you are a
    keen tennis player but can no longer play tennis after the accident;
    any disfigurement caused by the accident;
    any effect on your sex life.
    The law generally classifies injuries into four categories with range of
    award as follows:-
    Serious HK$400 - 540k
    Substantial HK$540 - 660k
    Gross Disability HK$660 - 1,000k
    Disaster above HK$1,000k
    By comparing your case to precedents, your lawyer should be able to tell you
    approximately which category you will fall into

    It sounds like she will be affected in her day to day life for quite some time, perhaps feels she cannot wear what she used to wear, embarrassed to go to the beach in a swimsuit, and it has affected your sex life - these are all lines you must use when negotiating.

    You should call a lawyer, will get better info than here and maybe just an initial chat will help give you some ideas. whether you actually hire the lawyer is a decision to make after that chat, but they will throw some figures about compensation out for free. ( I had a personal injury consultation over the phone about 2 or 3 years ago. )
