    Laws related to "street" marketing

    If I take a roll-up banner, or a large sun umbrella, stand near to the MTR, or some other place with lots of foot traffic in an attempt to talk to people passing by and sell them my services - is this legal?

    I have been trying desperately to find any laws or regulations on this, but clearly my google-fu is not on point these days as I haven't been able to find anything conclusive.

    Does anyone have experience with this, or know of any existing laws that cover this? I've heard announcements in the MTR advising people not to talk to real estate agents outside of the station, for example, but I have no idea whether this is just advice for the sake of keeping the entrance clear, or if there are relevant laws.

    Any help with this would be greatly appreciated. Oh, and I am not only asking specifically about the MTR, but also other locations, say near to the entrance of an apartment complex etc.

    obstructing government land, technically illegal, but phone companies and others, take the risk

    If your banner is advertising the benefits of communist rule or the NSL, totally legal. Otherwise it's a grey area.

    As long as you're on public land and not obstructing or selling foods like a hawker, no one will care, if police say move on, just pack up and move on.

    This recently came up in my company when I planned on doing street marketing, according to one team member's research you have to get a license/permission to do it but there is no method to do this.

    I also went ahead and spoke to marketing agencies and they said there is no license, they have never been approached by police but if need be, they will pack up and go, but that is how they operate.

    Would love to hear if you go ahead with this and see how it goes

    Hmmm i saw Somerbsy had a stand giving out free ciders at the central ferry piers last weekend.

    And then you see the charities like save the children and WWF doing it all the time, the elevated walkway above wanchai mtr station connecting immigration tower to johnston road is always teeming with people doing this, religious bodies, phone companies, refreshments, publications etc etc

    Perhaps you can ask one of them.

    FEHD has hawker licences for fixed pitch, fundraising and itinerant category. See which can be suitable for your purpose.
