    Property ownership status for non- hk resident

    Hello Folks,

    I (presently on dependent visa) own a residential property in HK (jointly with wife who is a permanent resident) and am contemplating leaving HK in an year's time. My queries are as below:

    1) I will be leaving HK for longer than 6 months and as per my understanding I will not be able to meet the 7 years' requirement for PR (which will be a bummer as I just got 2.5 years to got to get it but that's another story). Anyways, what would happen to my property rights then? Are there any additional taxes etc that we would need to bear, for just me being a foreigner despite my joint owner being HK passport holder? We plan to rent this property till we decide to return, perhaps a decade later...Anything else I need to be aware of?

    2) In the case I/we return after 5/10 years later, would the immigration dept take issue with my 'earlier departure' and be hesitant in issuing another dependent visa?

    One thing to keep in mind is that you wont be eligible for personal assessment so you'll pay a flat tax rate on your rental income. Apart from that I don't think you'll have any issues.

    You can leave--you will still own the place. Keep your hkid forever, that's yours. Why not renew your visa and return once every 6 months?

    I think keep the visa valid is the best idea --then you still try for the PR with your explanation for your temporary absence from HK. You might have a chance still.

    You should be able to get a new visa in the future without trouble unless you break some rules.

    I don't think you'll be able to renew the dependent visa so easily once you've left the country. At least that was my experience.

    Once you've returned its fine though.

    This is only true if your wife is staying in HK. If she joins you overseas then she won't be eligible for personal assessment.

    To be safe I would ask this question at Visageeza on the internet, he knows his stuff, has years of immigration experience, and is up to date on changes in immigration procedures, which do change over time

    Could you elobaorate on the reason why he would want to maintain his mpf account? The guy is getting a dependent visa so I don't think the mpf account is relevant
