    Is HK Tax Required To Pay if you have never set foot and have no ID Card in Hong Kong

    Hello All,

    I'm no tax expert and perhaps this question is a simple one. My brother has never set foot in Hong Kong before and has no ID card and perhaps never plans to come here anyway in any capacity? I believe he sold something here that was less than HKD250k and he recently got a tax form to fill out.

    My question is does he still need to do this? I have inquired about this to the tax IRD and they just say he needs to put his ID Card and HK address but they don't seem to understand he does not live here and never will.

    Just need to know does he need to fill this out and pay the tax?

    There is no distinction made between residents and non-residents when it comes to the profits tax.

    Profits Tax

    Typically the govt would put a travel restriction on those who owe taxes past a certain time limit, thereby locking them in HK until they pay. Obviously, this would only be a concern if he were to return to HK ever. Others with more knowledge may chime in.

    Was it a property, a car or ? Something physical or non physical?
    if he sold it in HK, the trading activity happened in HK, then he is liable for the profit tax, stamp duty, property tax, vehicle tax, or whatever name of the tax.

    Find out if he is really liable for the tax or not. Just ask the HK IRD directly and they will reply you with a YES or NO. If YES and he does not pay on time, he will be stopped and notify about the reasons when he enters HK, and will not be not allowed to leave HK until the tax is paid.

    Provide his non-HK address and passport number if he does not live in HK.

    And if he intend to pay, enquire about the payment methods. Maybe remit the amount to HK IRD from overseas?
