Resignation Notice Period

    Thumbs down Resignation Notice Period

    I've been offered a pretty good job and said that I had 1 month notice period which I used for my starting day calculations.

    However when I submitted my letter HR came back and said that I have a 3 month notice period in my contract. The new company will definately not wait 3 months for me, nor will many companies in fast moving HK.

    So what are my options to get out. Does HK enforce what it says in the contract and how can I negotiate an early exit?

    Can new company pay out the remainder of your notice period?

    When you joined existing company, didn't you read your employment contract???

    u can do a buyout yourself if the new company is unwilling to. pay them 2 months of your pay.

    Ouch ... that was one of the options that I thought ... but that ain't financially viable!

    Talk to your boss and see if he is willing to deal on the terms. No one wants an unhappy employee who is just there in the office because of contractual reasons.

    Quite common in my industry to have a 3 month notice period, actually its pretty standard.

    In any case you should have a copy of your employment contract. Its very important as it sets out your rights and obligations at work, regardless of how long you have worked at a company.

    Yea, HR showed it to me

    How can one plan for such an exit?

    So, you get sick of a job ... hand in your resignation ... need to complete those 3 months in a job you don't like with no job offer secured.

    Im the meantime you apply for jobs which have a vacancy like now as in my case. Will companies wait 3 months for you to finish your term, in such a fast paced moving city as Hong Kong, er .. I think the answer is "No!"

    Yep. I really was shortlisting for a job. got it down from 200 to 15, but needed to cut more because I wasn't going to interview all of them. One of the 15 was on a 3 month notice and was rejected on that basis. Tough but I needed someone then not in 3 months.

    Trust me, I know it sucks. My last employer also had a three month notice period in my contract but were willing to let me go after 6 weeks.

    Thing is in my industry, everyone has this amount of notice period, so if I were to move my future employer would be well aware that i wouln't arrive for three months (as they themselves would have a 3 month notice requirement).

    But like i said, it does suck.

    i love the 3 mth clause, since i don't have to get back to office the day i resign. i'd effective get 3 months of break. ahahaa...
