    Wages

    Hi,

    Now that i left my previous co , i was told my salary and unused leave etc will be paid within 7 days after I leave.
    Have searched under labour dept and it says "pay wages to an employee as soon as practicable and not later than 7 days after the end of the wage period and after the day of termination of employment"

    It's past the 7days of the monthly pay day and they have not paid even after the day of termination. Does the 7 days include the weekend? Since the CNY holidays are coming up can they give that as an excuse to postpone in paying my salary?

    I am looking for a job and till then need the extra $$!


    Anyone come across the above situation?

    Call the Labor Dept. to mediate the situation.

    You haven't made clear your situation. If you are on an employment visa with the company and you have no job you are moving to then yes the employer is within their rights to withhold the last salary until all tax issues have been dealt with with the Inland Revenue.

    If you are a PR or on a dependant visa then yes you will need to contact the Labour Department and get them involved.
