    Notice period

    Hello, my current contract will end by Apr 30, 2024 with a 3 months notice period clause. HR now asked me to renew my contract for another 2 years, i.e., from May 1, 2024 to Apr 30, 2026.

    1. If I found a new job now (say Nov 15, 2023) and submit my resignation with 3 months notice period, when is the effectivity date of my resignation? Is it Feb 15, 2024 (Nov+3M) or Aug 1, 2024 (May+3M)?

    2. Also, is it better to sign a new contract now or wait around 3 months before expiry of the current contract. Thanks.

    1. Date of resignation - 15-Nov-23, Last day of work - 15-Feb-2024
    2. Depends, do you want to change the job?

    You are always under one effective contract at any time. All depends on the terms and conditions of whatever contract is effective at that time.

    Lots will depend on your situation. If your industry is small and everyone knows everyone else, you can consider just working to the end of the contract 30 April and not renew. for The new job you can ask them to defer the start date to 1 May, stating you just want to see through to the end of your contract given it's only 6weeks difference vs resigning and the last employment date will be 3months from when you tender resignation.

    Also, if your current work are sponsoring a visa/work permit that will need to be changed by the new employer also.

    Lock in the new contract - or play for time now and negotiate terms for the new contract that are as best as possible.

    Can always resign at any point in time with 3-months notice.

    Thanks. I'm planning to if there is a better opportunity. I'm not sure if the new employer will wait for me for more than 4 months as I want to get my gratuity from my current employer.

    Of course its not August next year. You dont have to work until the end of contract plus 3 months. eg If you sign a new 2 year contract until 2026 now, doesnt mean you are forced to work there and cannot leave until 2026 + 3 months

    If new job is better, give notice now and start new job February 15th is fine. But depending on your job, who you are working for, whether you like your current company or not, how many people you want to piss off, etc, you may want to consider working to April 30th to see out current contract. Tell new company you can start May 1st.

    I think you already know the answer in that case, do not sign the contract now and start finding new employer, hopefully you can find something before the end of current contract, if not, reevaluate the situation and see you want to stay home for a while and still find new employer or sign new contract with current employer (assuming no issue with it)..

    Thanks. I really want to get the gratuity so I should have submitted by 3 month notice by 30 Jan and my last day should be Apr 30. Do you think my new employer (if I found one) will wait for me, say Nov 2023 up to Apr 2024, that's almost 5 months!
