    trouble?

    hi guys,

    really need some help.this is for my friend .she was working with a good interior design firm and is on the working visa which still holds for 1 more yr.she has now got a better job with better pay.she is worried coz she doesnt have a certificate.she is worried if her new employers might reject her or if her current employer might write to them or the immigration etc etc.......she is totally confused.she is awfully smart.

    wat do u guys think?the current employer cudn possibly write to the immig that she has no cert right?coz he sponsored her for more than 3yrs now....

    An employment visa is only valid while she is employed by the company that sponsored her, when she left for another firm the employment visa became null and void.

    The company that sponsored her visa is by law required to notify immigration dept. if when the employee leaves the firm. However, it must be said that some companies forget to do the paperwork.

    Legally she must ask the new company to sponsor her and apply for a new employment visa.

    She can't escape or hide because although lax with immigration filing most are on the ball for filing (employee commencement and departure) tax forms because of the MPF administration.

    Thanx for ur reply JAherbert,

    Yup, she is aware of all those rules but she is worried bat the certificate.she doesn have one.Will that be a problem to get the new employment visa?

    please clarify what is the meaning of "certificate"?

    are you refering to some type of qualification????

    Anyway since she obtained an employment visa via the first employer without the "certificate", it is reasonable, considering the increased pay, to think she will get the next employment visa without the "certificate"
