Sorry but it is not up to the employer to ensure that tax is paid. My company also withheld my last month pay this guys sounds like he was trying to avoid paying and still is.

Perhaps, but they are legally obliged to notify the IRD one month in advance of an employee leaving and to withhold the last month's payment until they have clearance from IRD. Details here: http://www.ird.gov.hk/eng/pdf/pam46e.pdf
