confused about "prosecution" in traffic accident

    confused about "prosecution" in traffic accident

    I was in a minor fender bender and I got a notice of intent to prosecute - yet it says it doesn't mean I will be.


    In HK is that just a formality to help determine "fault"?

    Does it usually apply in minor traffic accidents where no one was hurt? or does it apply to big offenses, like DUI, running into a person, etc.?

    I'm from the states, so can you help me in terms I would understand?

    Most likely a legal statement that if they do find you at fault they have the right to prosecute is what I read of that.

    Where you at fault, did you go through a red light or cross solid lines etc, they might charge you will driving offences like careless driving or dangerous driving.

    My 2 cents.

    They do that to leave the biggest window open for themselves if new evidence comes to light.
    I made a wrong turn into a one way street once in unfamiliar CWB and the cop told me I could be prosecuted with dangerous driving (criminal offense), in the end it was just a ticket....
