    Traffic accident lawyer advice

    Hit by another vehicle and they are prosecuting me despite the evidence.

    Anybody recommend someone who will affordably tell me if its worth fighting?

    Anybody been to traffic court to defend yourself, what was it like, was the judge fair?

    I don't think that anybody would stop in Hong Kong unless they knew the person. I'm sure a couple of vehicles behind us had cameras, maybe I'll search YouTube.

    Need more clear details on your accident.
    Read this thread especially post #53, contact @gunsnroses through PM to get his advice as he's been through the ordeal.

    Police prosecution for a traffic incident is standard procedure. I got the same letter even though I clearly wasn't at fault at all.

    John, this seems ridiculous as they're prosecuting you when you're the victim. In my case police saw the light and dropped the case. But a friend of mine is going through the same case. Where a cab on a single lane street tried to overtake his smart car because he thought he could and banged in to him. When the police came and spoke to both, the cabbie offered to pay 2000 hkd but my friend refused as it probably wasn't enough. Now the case is heading towards prosecution and last I heard he was called to the police station to give his statement. I'll check with him as to what is happening and what he plans to do there.

    Any lawyer advise, court stories, and settle out of court stories appreciated.

    So the Smart car is prosecuting the taxi or vice versa? It seems to me whoever speaks Canto and files complaint first has the upper hand, at least my case.

    Yes the person who calls the police first is gold here irrespective of who caused the accident. Of course if further investigation reveal that he was lying then that's that.
    It's the cabbie prosecuting my mate as he called the cops first.

    Actually the standard in all traffic accidents where agreement hasn't been reached is to send standard letters saying you could be taken to court and to have to go and give statements. In that case both drivers will receive the same and if agreement is reached it gets dropped otherwise both drivers get taken to court and blame apportioned then. You can back yourself up with garage reports and surveyor reports if you want.
