    Traffic accident - do I get screwed?

    Had a traffic accident, was hit in the rear while stopping at a STOP sign turning right. Other driver probably looked left to check traffic. Quite a new car the other one.

    Actually pretty clear. So far. Guy apologized a lot while we waiting for police to arrive.

    Police did their job, and the police guy ask me how it was, so I told him the obvious. He then said the other guy claimed I was driving backwards. He claimed he has no car video, I have in theory, but found out the SD seems bad.

    I was alone in the car, they where 3. Do I get screwed?

    Buy a car cam, front and rear.

    Solves these issues very quickly when the Police can view the cam footage on the spot.

    Err he or she did have car cam just that the memory card is kaput
    @happy_camper stick to your side of the story, report it to your insurance company as well as said by DeletedUser.

    What road did it happen on, ill try to see if anyone posted footage on local FB groups. If you know of any local FB groups you should ask if anyone has footage also to help make your life easier from this he said she said Bullshit scenario, the other driver will do anything to get out of paying for your repairs.

    Thanks so far!

    I will then hand it over to my insurance. I haven't checked the CAM in a year or so, big mistake. Buying one is good advice, but does not help me much right now.

    What is the usual presumption in these cases? Would have thought the person rear-ended would be the one getting the benefit of the doubt.

    People don't generally just "back up"
    And finally a crash when backing up is usually a lot more minor (due to low speed)
    I was thinking exactly these two things, but wondered if there was any physical evidence to differentiate the two scenarios. The amount of damage was left unmentioned but possibly low speed as well due to approaching stop sign.

    The damage on my car is certainly not consistent with a backup contact.

    They took a lot of pix from all angles. It's still a rather minor damage and they car still drives. But I got 2 cars and 2 moto!

    You get a lawyer to make the other passengers sign an affadavit that the camera was not functioning and that you backed into the other driver's car. They will get scared and not lie under oath IMO.

    Police will only care if a crime, injury or damage to
    road infrastructure is involved. It's an insurance thing and only if you can prove 100% he did it, then they just pay for their own damage and you both lose some NCD.

    Invest in a better camera front and back to protect your NCD.
