Yes, common to patent a new use for a known medication (we do it all the time, find some herb, for example that is known in Chinese medicine, has anti-HIV properties- the patent is for the "method of use"...).
May be doing it purely to prevent Gilead from doing it...as patent filing are not published until 18 months, why else publicize the application?
And can even patent using a new combination of known antivirals (like mixing Tamiflu with anti-HIV drugs). Going to bet that's been applied for as well...
