'The UK claims universal jurisdiction for torture. In a press statement the group said a private prosecution “of senior British officers in the jurisdiction of England and Wales under universal jurisdiction provisions” was one of the few remaining options for justice.
It added: “At virtually every major protest, officers have beaten defenceless activists and bystanders and deploy disproportionate force with impunity'
So if you are a British Citizen committing torturous acts you are fair game for prosecution where ever or for whoever you did these alleged acts. Much like the much simpler route Ms Lam could of taken last year if she had enabled the trials in HK of murder carried out outside the SAR.
There are around 1500 British subjects in the HKPF working for what some might suggest to be the CCP enforcing laws that appear directly against the Joint Declaration.
This is very interesting. I have two questions:
1. Could potentially all cops with a BMO passport be targeted? Or only British citizens?
2. Could in theory all HK cops (with a British or BMO passport) be be targeted, simply for being members of the police force? How could this be argued/justified/what case could one make? Would it need to go as far as the UK government declare the HK police force a terrorist organisation (which of course it could and would never do), or can the lawyers simply argue that the police force has consistently and institutionally acted with excessive force, disregard for the public's safety, disregard for HK and international law, etc., so any member of the police force is equally guilty and can be prosecuted?
