    Employer doesn't pay MPF...

hi! My new employer doesn't want to pay my MPF telling me that I am a foreigner with a working visa... bla bla bla, and I am not entitled to it. This is such a bad excuse, as all my previous employers paid MPF and knew the law - it is a must.

Could you please let me know where I could find the MPF Legislation on the web? I would like to show it to them. Thank you!

    Susan

You don't seem to be very good at picking your employers do you?

Have you ever had an employer who you didn't have a problem with?

    Does this tell you anything?

Susan -- find out who your employer banks with, if its HSBC, contact their hotline and ask them if this is true. Will work wonders -- HSBC will call the employer and tell them that they're doing it all wrong.

Hi hope someone can help me too.

I've just been employed and told that the company wont pay my for my MPF and i will have to arrange it myself.

    A few questions...

    1) Do i need to be living in HK for 5 years before a company contributes to my MPF?

    2) I've just arrived from UK 3 months agao, and currently I am employed as a local because i have a ID Card. So no expat package

    3) MPF is mandatory, so if my employer dont contribute i will have to find an MPF fund and contribute 10%?

    4) Is this the norm?

Thanks I really need some advise about this.

Wrong. Every employer and employee MUST contribute irrespective of your length of stay or employment.

An employee refers to any full-time and part-time employee who is aged between 18 and 65 employed under an employment contract for a continuous period of not less than 60 days. Meanwhile, in the construction and catering industries, casual employees engaged under an employment contract less than 60 days are also covered by the MPF System.

    Thanks for that...
so if my company claims they dont operate an MPF scheme then they are breaking the law?
Which types of companies are exempt?
    Can any company be exempt?

Sorry a lot if questions i know but gathering info before confronting them.

Most if not all the information is on the MPF site. Would strongly recommend you contact the MPF authority with questions.

You definately do not want to go into a confrontation based on "I heard it from a know it all on the internet".
