    Angry Legal Advice - being overcharged by phone company.

    Hi All,

    I recently moved back to HK after a 2 year hiatus to find that my previous mobile phone provider had been charging my Cathay Pacific Amex for the line rental whilst I was gone.

    This is despite my best efforts to cancel the contract prior to leaving 2 years ago (I had one month to go and I was told it would expire and I would have the last month to settle).

    Hence I have paid xxxxxxxx company over 11K HKD over the past 2 years.

    I have been arguing with them all week and we have come to a stalemate where they say they will reimburse me for 6 months of payments.

    Do I have a legal leg to stand on here since I have no proof that I asked them to disconnect me and was given wrong advice?

    Any ideas or thoughts from people who might have been through similar situation?

    Small claims tribunal?

    However, seeing has you have written proof, its going to be tricky.

    Given that you have no proof, I'd rather go for the settlement - I know it sucks, but without proof (and didn't object to your credit card being charged) you have nothing to support your case.

    Have you tried using your credit card company to fight this? Many cards have provisions whereby they will refund erroneous payments and chase the company on your behalf (although this seems to be much rarely in HK than in most other places I have held cards). It's worth a shot.

    I think there is a time limit on claims
