    Traffic incident - police prosecution

    Two weeks ago my wife was driving to TST via Hillwood road. The road is narrow and made narrower with cars parked so she was driving pretty slowly (20-30 kmph). Suddenly a guy wanting to cross the road walked in front of her car and as he came out from behind a parked garbage truck, my wife didn't see him and the side mirror grazed him. She obviously stopped and this gentleman started yelling at her and called police. 5 cops came then ambulance came (trust me it was quite a big drama), he complained of pain in the hip. Which my wife's witness pointed out that how come the side mirror which as at your shoulder height, grazed your shoulder but the pain is in the hip.
    The cops took his statement, took my wife's license details and ignored the request of my wife and her witness's request to take statement. Just said they'll contact in 2-3 weeks.
    We thought they can't be bothered to prosecute as it's obviously a case of jaywalking. But lo n behold today we got the letter that's a notice of intended prosecution.
    What can we do here? Hire a lawyer? This in my opinion clear waste of everyone's time and money. Any sensible cop should have closed this case there and then, but even five cops couldn't see it as a waste of time.
    Appreciate any advise.
    Just FYI my wife is an excellent driver, 10 times better than I am.

    Yes we found it strange too that they didn't take the statement from my wife or her witness. That's why we assumed the cops don't really intend to prosecute and it is more of just a show to calm that screaming idiot down.

    Just tried calling the cop on the number given in the letter but he arrives at 11. Will keep you all posted.

    Should they decide to prosecute, do not plead guilty ( Though it is cheaper option). Fight the case.

    Personally I would hold off on spending $ on legal fees at this stage.

    If the summons arrives then there will be plenty of time for lawyers.

    It cost me $25K 10 years ago in legal fees. Before the summons, she will be asked to come to the police station to make a statement. Please go with her. Make the statement as brief as possible. Emphasis on the side mirror.
    No need for the lawyers at this stage.
