    Previous Employer relocation DH question

    Hello,

We have found a helper who was looking for a new job in the HK as her employer has relocated. Problem might be, they started the relocation slowly (family didnt move right away but husband started to work) and they moved into their other family members home while the husband set up their home in the new country (close to hong kong). Now they are officially ready to "move" to their new home (they have been back and forth many times) and helper has stayed at the hong kong family home during this time of 9 months. Will this be a problem for us to hire her? Does this break any rules that they had a transition period while they officially moved?

    thank you for your help.

As long as the previous employer informs Immigration they are terminating the contract due to relocation and doesnt mention anything else like they moved to a different house, took bloody 9 months to finally leave blah blah blah, it should be no problem for you to hire her as this does not effect her record.

Yep, the simpler the termination letter "Terminating due to relocation overseas" the better it is.

Any 'fine print' will just complicate things.

I guess my concern lies where ID contacts the previous employer and they will supposedly be asking questions and then we might get into trouble there.

They dont .. .we've never been contacted and have had helpers leave and have hired 'terminated' helpers for 14+ years now.

    A simple letter is enough.

Immigration only calls if a helper has numerous terminated contracts and may investigate. If the termination letter says relocation, it should be fine.

You are trying to hire a helper why do you think you will get into trouble unless you lie on your application, if any thing happens its will be to the previous employer or to the helper.

    You're worrying too much

thank you - we really like her very much and want to hire her so want to make sure we do exactly right! Also, helper mentioned that she also needs to give immigration her own release letter? is this true?

I don't think she needs to write her own release letter. Think the one from her current employer stating the reason for her termination is more important.

Anyway if she does, its just a simple letter reconfirming everything the employer has written.

With our previous helper, her employer's refused to give her a release letter until her last day. This meant we couldn't start her paperwork early. The Immigration officer suggested she write her own release, stating she will not be renewing her contract with them and her last day.
