    Divorce Maintenance

    Can someone tell me:
    If one fails to pay maintenance in a divorce, what will be the legal consequences?

    The person who is due the money will return to the court which granted the maintenance to ask them to apply legal sanctions to get it.

    How exactly that happens depends on where the two parties are and the jurisdiction of the court which made the maintenance order.

    Can the person appeal to extend or delay the payment of maintenance?
    If the person fails to pay, will he be imprisoned for non-payment?

    Was the settlement agreed by a court and was it in Hong Kong?

    Which country's courts was the divorce & maintenance agreement made in? Hong Kong? And where is the person who isn't paying living?

    In many countries the court can tell your employer to deduct the payments from your salary before they give it to you.

    Why don't you just try and talk to your ex wife and explain your difficulties in paying and try and come to a compromise without having to resort to Lawyers and the Courts thus incurring more financial burden.

    The divorce and agreement were made in Hong Kong. Wife in Hong Kong. Husband in Malaysia. Husband having great financial difficulty. Husband receiving letter from Legal Aid Department, Hong Kong, asking for payment

    Then I suggest the Husband writes a letter to the legal department to admit to financial difficulty and trying to come to a resolution to try and make some sort of token payment to the ex-wife to at least alleviate some of her financial burden.

    And the sooner the better as the previous rate will continue to be calculated until a legal amendment is made.
