    FDH marrying her bf with HKID

    my helper is nepalese and i hired her in december 09. she is great with my bub and the domestic chores and we (including our bub) are very happy with her.

    she had been dating a nepalese man who is a permanent HKID card holder and the man recently proposed her and she said "yes". i'm very happy for them and would like to help them in any ways, even though that means that we'll lose her as a helper when she gets a dependent ID.

    she has been asking me if i can gather information regarding her status of a FDH - getting married - getting a dependent ID. i think that she will have to terminate her contract with me and return to nepal and wait for her hubby-to-be to process her papers as a dependent. i would appreciate any helpful comments on how/if she can apply for a dependent ID after marrying her bf on her current FDH status and whether she needs to return to nepal for this process.

    No - she can apply for change of status. I see no reason for her to have to terminate her FDH contract or to return to Nepal. Perople change from Employment Visas to Dependant (and vice versa) frequently without any such need. However, the Dependant Visa might take a while to process - I suspect ImmD will push for evidence that the relationship is genuine rather than one of convenience.

    If she wishes to continue to work for you after she is granted the Dependant Visa then I don't immediately see why anything much would need to change. She would still have a contract of employment with you - she simply wouldn't need to use it to get a visa any more. Of course, you might wish to renegotiate the terms of the contract with her, but that's just a matter between the two of you. Once she's on a Dependant Visa her employment contract is not subject to any more restrictions than any other employment contract.

    thanks PDLM. that's great if she doesn't have to return to nepal. i'd love to still have her as a helper but she wants to earn more so after she gets her dependent ID, i'll have to let her go to let her earn more and make space for the new one.
