my child born in HK, my girlfriend is Hongkongese.

    HI all.

I live in HK with my girlfriend who is HongKongese and I'm getting a working Visa.
We'd like to have a baby in HK, I know that my baby will have the right of abode until 21 years old, but what about after 21? will he need Visa or something? or just ask for the ROA by him(her)self?
And about me, I'm wondering if I have to wait 7 years to obtain the right of abode, If I have a baby in HK, have the immigration planned something special for this case?
    Thanks a lot.

You will not be legally recognised as the father unless you are married to the mother when the child is born. That is the essence of illegitimate children.

Your child would be a HK Chinese citizen if that's what the mother is. They will have lifetime Right of Abode from birth which cannot be lost. They would also be entitled to a HKSAR passport. If you are not married to the mother then the child would not be entitled to take your nationality in all the cases I know of (we could be definitive if you tell us your nationality).

Parents do not get any extra rights by dint of having children born here. You would still need to reside here for a continuous period of 7 years to get ROA.

A friend had a baby a couple of years ago, with her bf. Both of them had to go immigration to register the birth and apply for the child's birth certificate. I would think once your name is on the child's birth certificate you can apply for a French nationality for her.

I think you are being old fashioned there PDLM. From the UK gov't website:

If the child was born outside the UK
IPS needs to see the child's full birth certificate* or adoption certificate showing parents' details and one of the following:

section 4 of the application form completed with the British passport details for either parent**
UK birth certificate for either parent**
Home Office certificate of registration or naturalisation for either parent**
the passport that was valid at the time of the child's birth for either parent**
Note*: if the child has a birth certificate issued by a British consulate or high commission, you do not need to send any other documents.

Note**: if you are sending the father's documents, IPS also needs to see the parents' marriage certificate if the child was born before 1 July 2006.

I just verified on the french consulate's internet site, and if I have a child born in HK, even if I'm not married with the mother, my baby gets the french nationality and passport...
Jimbo, make sure what you're saying on this forum, some people could make some mistake...

P.S. to say you are not legally recognised as the father if you were not married at the time of the birth is tosh. For example: on the Philippine birth cert if you are not married the father has to sign on the back to accept that they are the legal father. The HK immigration dept accept "illegitimate" children as dependents. Try telling the CSA in the UK that you do not have to pay support because you are not the legal father!
