    Dependent VISA for Mother

    I am a permanent resident of HK and I have applied dependent visa for my mother. She is widow and 54 yrs old. According to Immig. policy the dependent mother's age should be 60 or above. The Immig. Dept. accepted my application and I have submitted all the documents that they asked me. After the process of 5 months, the officer said that they were satsified with the submitted documents but the due to the policy they cannot grant her visa. My mother has to stay with me and she has no choice coz my father recently passwed away. I have to take care her.

    Can anyone adivise me what shall I do further to convince the immig. officer to understand?

    I guess that the Immigration Officer understands, but certain things are not within their discretion. You might enquire as to whether you have the right of appeal to the Immigration Tribunal, but frankly I doubt it - the rules are the rules.

    If you did get granted the right to appeal then I think you would have to make a very strong case for why you say that your mother must stay with you. 54 is hardly old - most people still have at least 10 years of their working life ahead of them at that point. Is she disabled or somehow otherwise unable to look after herself? If so I guess that would help the case.

    You might also enquire of Immigration whether they would grant an extended visit visa for her which might get her here for a year while you looked at other options. She wouldn't have the right to work on that as she would on a dependent visa, but I guess that's not important to you.

    The radical option would be for her to have a marriage of convenience to a Permanent Resident - I have heard that agencies exist which can arrange these for a fee (it's normally done to get SE Asian workers into HK for work in the service industry, or so I heard).

    Thanks PDLM for your prompt reply.


    She could not work and never work before as she is home maker. I would like to keep her under my care which is good for her. She is in HK now. I had interview with Immig officer last week and the officer confirmed that NO grant. But he gave another one month extension. I have to do something in this one month to make him change. Could you please little elabarote how I could make the Immg. officer to satisfy?

    Like I said, the rules on this seem more or less fixed. I'm sorry to say that I don't think the immigration officer has the discretion to make a grant whatever you say. You can make a formal request to make an appeal to the Immigration Tribunal (ask the officer for how you go about doing this) but I really would not hold out great hope. I fear that you need to be using the next month to work out if there is somewhere else in the world where both you and your mother would be allowed to stay (I guess her home country, for example).

    I have just recently read some HK government legislation that if a widow or widower wishes to live in hong kong under a dependant visa, then it is ok and does not matter who they are as long as they are family in one way or another

    If you mother is in HK, I suggest that you get a Health Care or Insurance for her. Since she does not have a HK ID and would not be eligable for the Health Benefits. It would be really expensive if something happens (just practically speaking). I have a relative who had a stroke in Singapore and it cost around HKD$10,000 a day for the ICU.

    The process is still going and her visa has been extended for six times by one month since the application 's submitted. Waiting with the hopes. If you have any suggestions pls give.

    Hello again,

    ok i have copied this from the immigration department of
    hong kong's website, it may prove useful

    under existing policy, for humanitarian and compassionate reasons, widows of any age or widowers over the age of 50 may apply to enter Hong Kong as dependants to join their nearest or only surviving relatives who are residents in Hong Kong. Under the new policy, both widows and widowers would be subject to the same age requirement i.e. they must be aged 60 or above before being eligible for exceptional treatment as dependants;

    Sorry I'm not familiar with it.. Since when I learned that as long as you have a HK ID, it would be covered (minimal cost only incase of an emergency).
