    British Born Chinese with HK citizenship (dual)- how can future baby have dual too?

    Hi everyone,

    I've got dual nationality because i was born in UK.
    My parents were born in HK, so I also gained HK ID card because once we got the Child ID card, we came back every 3 years until when i turned 18.

    Anyway, I got married to a HK guy and I'm living in HK now. I want my future child to have dual nationality too. Is there anyway for this?

    I have been planning to go back to UK to have the baby then come back to live in HK once the baby is able to fly.

    I'm also wondering that if I have the baby in HK, then would it be difficult to gain dual nationality because my husband is HK (Chinese) citizen?

    'we came back every 3 years until when i turned 18 rule" never really applied to overseas chinese to HK parents, my younger brother didn't come back toi hk for 7 years and still obtained 3 stars roa adult hk id card

    if you have your child in UK, they will have to live continously in hk for 7 years for a pernament hkid, your child will have uk citzenship by defaut regardless where he/she is born

    Oh. So I should have the kid here in HK then apply to British embassy in HK?
    Then the child will be a chinese citizen from birth and British nationality from me?

    Are you sure you are a Chinese citizen? I guess you only have an HK Permanent ID Card and are not eligible for an HKSAR passport.

    If you are really a Chinese citizen (none of your parents was settled out of China when you were born), you didn't need to fly back and forth every 3 years. Your baby will be a dual national if born anywhere in China (CN, HK, MO, or TW).

    yeah, but if he/she is not born in HK, she/he won't have a hkid (nor dual hk/uk nationality) hence, why mainlanders pay from HK$38,000 plus in fees and hospital charges (i believe this is the min) to have their child born in HK and that hk born from mainlanders parents have increased many folds and now accounts for 60%- 70% of all child born in hk

    I do have HKSAR passport. My HK ID card is with 3 stars and I had come to visit HK within every 3 years. Whereas my brother was a month over 3 years and he's only got 1 star on is HKID card. He can't get China entry permit but I can.

    So if my future child was born in UK then brought back here to HK, they would need to live here for 7 years to gain Chinese citizenship. Would I face having to pay more tuition fees and not be eligible for HK children benefits etc?

    According to camborambo1, a Cantonese/English speaker with an Asian face, her husband is an "HK guy". It is reasonable to assume this "HK guy" is "an HK permanent resident with Chinese nationality" who was either born in HK or have ordinarily resided in HK for a period of at least 7 years. A child born to this HK guy in CN/HK/MO/TW will be an HK permanent resident with Chinese nationality.

    If the "HK guy" is unfortunately not "an HK permanent resident with Chinese nationality", camborambo1 please provide details.

    Forget about the */***, HK ImmD issued too many of them in error. And your HKSAR passport may be revoked if it was an error and you try to renew it. The key to your Chinese nationality is your parents' residential status at the time of your birth.

    Your younger brother is apparently not an HK permanent resident with Chinese nationality, otherwise he would be eligible for HKSAR passport and HRP. Even if you had got your HRP in error, you will be able to renew it in future.

    If your baby is born in UK, it will not be a Chinese citizen (unless you are determined not a Chinese citizen). The baby can acquire ROA in HK after ordinarily residing in HK for a period of at least of 7 years, and can acquire Chinese nationality at the cost of British nationality (which can be re-acquired). Don't worry about benefits -- your UK-born baby can become an HK resident easily.

    Got a mo' to reply a bit.

    Because you hold a full British Citizen passport (e.g. having been born there), if you choose to have your baby in HK he/she will gain Brit citizenship by descent when you apply for it. 'By descent' == > if, later, he/she also wants kids to have Brit passports, they - that generation - must have been born in the UK first (no such restriction if, in the first place, you have your baby in the UK).

    Think it doesn't matter if your hubby's HK Chinese or whatever; he can't suddenly decide to join you and baby to live in the UK anyway without first having gone through their procedures (e.g. paperwork, sponsorship, leading to a certain number of years living/working there, so on).

    PM me if you've still got queries.

    I've not bothered applying for an HKSAR passport because my parents were most likely both 'settled abroad' at the time of my birth (they've mislaid old docu/passports anyways so I can't provide proof), but I got a Home Return Permit with my ROA*** ID when HK ImmD AND the CTS agents/mainland officials were less strict about checking these matters/applications, pre-2004.
