    Dependent visa to ROA

    Hi. I just moved here six months ago and has worked for four. I'm currently holding a Dependent visa ('cause of my dad) and would like to apply for ROA. I got it when I was 17, now I'm 24 and have been coming back to HK every six months since then. I was studying in the Philippines during that time. Will I be able to get an ROA if I apply for it?

    The condition is that you have to be "ordinarily resident" for 7 years continuously. Studying overseas is not regarded as interrupting "ordinary residence" provided that you return to reside in Hong Kong for the long vacations during your course. If you were doing that then you should be OK. But a token visit for a few days once or twice a year isn't going to work. At the end of the day it's at the judgement of the case officer, but you've got nothing to lose by applying.
