Can you work and start a business as well on the IANG visa?

    Hi,

I have recently graduated from City U, and now I will be applying for the IANG visa. So I was wondering if its possible to work full time on the IANG, while having your own "Online" business as well...i.e. a business that is entirely online, but officially registered in Hong Kong.

Any one have any information on this?

    regards

Since you have recently graduated, you will be issued a one year IANG visa. During this period you are free to study, take up any employment or engage in business. However at the end of first year you need to prove that you have a job that is at the level of your study or proof that you are engaged in business.

The Government of the Hong Kong Special Administrative Region - Immigration Department

"10. Non-local fresh graduates who wish to apply to stay and work in the HKSAR are not required to secure an offer of employment upon application. They may be granted 12 months' stay on time limitation without other conditions of stay"

    Thanks for your reply;

    Immd website states that:

    "Extension of Stay

    18. Persons admitted under the IANG may apply for extension of stay to work in the HKSAR within 4 weeks before their limit of stay expires. Upon application, the non-local graduates are required to secure an offer of employment which is at a level commonly taken up by degree holders and the remuneration package is set at market level. For those who have established or joined in business in the HKSAR, they are required to produce proof of their business. Successful applicants will normally be permitted to remain on time limitation on 2-2-3 years pattern without other conditions of stay."

i.e. those who receive the IANG visa can both work in Hong Kong or start there own business.

What I am wondering is, if both can be done concurrently...i.e. run a business and work full time as well.

    Any ideas?

of course, it says, 'without other conditions of stay'.... that means you are allowed to do what you want. but if you want to stay after the 1 year, then you need to be able to prove your involvement in the business etc.

    Yeah i get that,

Sorry I think i should have clarified that I meant..can I work full time in another company/firm, while having my own company/firm registered in Hong Kong as well...

The ImmD doesnt mention it explicitly.

I asked some similar questions in person after I graduated from CUHK, and ImmD's answer was always the same - you basically have the same rights as a local graduate, all they want is proof (after the first and third year) that you can provide for yourself. According to what they told me, this would even include the option of working some time and then starting a business - they would extend your visa if you can show that you saved enough money and don't have to rely on your business.

yes, you can. again.... NO CONDITIONS OF STAY.... that means you can pretty much do whatever you want...for a year.

do you expect them to write immigration ordinances with specific examples? the question has been answered now 4 times (including er2's response)...

    Ok cool. Thanks for replying

Off course I dont expect ImmD to right everything explicitly, But i think its reasonable for me to not assume anything is true, without explicitly asking if it is.

    Sorry if i troubled you.

    Peace.

And thanks too er2 as well

easy, carang.... This is one of the few areas where it is good to be careful (remember that Greek/German guy who overstayed his visa by 18m..?)
And it really can be confusing - especially since the visa itself does not contain any clear statement of what you're allowed to do, either. It just says 'Previous conditions of stay are hereby varied:' and then nothing, as the part that restricted you to studying is simply removed from the visa...

maybe you need to go back to school and work out what 'NO CONDITIONS OF STAY' means? if you dont like answers on a public forum, go ask lawyer.

how is overstaying on a tourist visa by 18 months related to your situation?
