IANG Visa extension in progress, HR says I can overstay on current visa :S

    IANG Visa extension in progress, HR says I can overstay on current visa :S

    Hi,

    So as an update to my post yesterday over here:http://hongkong.geoexpat.com/forum/5...ml#post2575353

    Today the HR lady is back. I asked her too call the Imm D and they told her that my application will take another 2 weeks. This means that it will take till the middle of October. Only problem is my current visa expires on the 3rd of October.

    Interestingly, the HR lady says she asked Imm D and they are saying I can overstay on my current visa as long as I can show them the application receipt card. Is that ok?

    It makes very little sense to me, that I will be allowed to overstay when my visa renewal is in progress :S but I asked 3 times and that is what the HR lady is telling me.


    Kindly advise on what I should do? is there anyway I can get a temporary visit visa or something like that, without having to leave HK??

    Just to be clear, I am a Pakistani citizen..so I believe going to Macau also wont help

    I would insist on getting something *in writing* from immd confirming you are allowed to stay - and work - whilst your visa is processed. I've never heard of them saying this before, but then again I've never heard of them being this backlogged before.

    what if Immg suddenly says your visa was not approved that means you would have to leave the day they tell you and you will probably be arrested while trying to leave for overstaying your visa, without black and white proof the immigration officers will not believe you. Get your HR lady to provide you with black and white evidence.

    If I were you I would go and apply for Macau and China visa and see which one you can get, tourist visa should allow you to stay in those countries for at least 2 weeks if not 30 days.

    The sticker on the visa receipt says that I have to be physically present in HK to get the visa. So assuming I leave HK, i would need to return on a visit visa isnt it?

    forgot you have Pakistan passport part, can you get visa on arrival for HK??

    Holy crap, you are screwed. I would go to Immigration tomorrow and discuss with them directly, ask them for options and how to get visa extenstion etc, also tell them what your HR said and if its true.

    Do not listen to your HR, in my experience dealing with HR depts in HK, not one of them slimy feckers can be trusted

    I'm sure it's not that bad. Apparently immd have said he can stay - lets assume that's true. Best not go anywhere in the meantime. But again, ask your hr lady to ask them to send her a fax confirming it. They will understand.

    This. I think there is a kind of temporary extension available for people whose visa renewals are being processed, although that might just be dependent ones. (Sorry, not had to do the whole visa malarkey myself so can't talk experience.)

    For your own piece of mind why don’t you call HKIMM and speak to them yourself. Also, when HR called on your behalf HKIMM may have recorded the query on the system.

    Finally, when I was a student in the UK and I applied for renewal of visa, as long as the Home Office receives your application before expiry of visa there is no problem.
