    Having a baby

    I'm a foreigner who's married to a HK National and I'm on a dependent visa. We've been together for 4 years and we want to have a baby. Seeing as I'm a foreigner I'd like to ask a few important questions before we have a child. Would the child be able to become a citizen of HK PRC when it's born? What will happen to me, could I get a Permanent residency after it's born or will I still have to exist on a dependent visa? What if, god forbid, something bad happens to my husband like death/accident or divorce, what will happen to me and the child? Can me and the baby stay in HK or do we have to leave HK if anything bad happens to my husband?

    Your child will be a Chinese citizen of HK, assuming that it's born here. You don't get any extra status by having a baby here, but after 7 years of living here you get Permanent Residence in your own right.

    If your husband were to die my guess is that ImmD would grant you unconditional stay until you were eligible for PR, particularly if you clearly have the means to support yourself. If you get divorced then the outcome is very uncertain.

    I'm guessing here, but it may depend on whose fault the divorce is. Also, you should very soon have a visa which will take you to 7 years, so that makes things simpler. As I understand it you don't lose a Dependant Visa by getting divorced, but obviously it can't be renewed subsequently.

    The child will have C. nationality and ROA for HK no matter where it is born.
    Unless the child's father settles abroad permanently or renounces his own C citizenship before the child is born.
