    Newborn with HK Passport applying for U.S. Passport

    Hi, our baby received her HK Passport and we would like her to get her U.S. passport (i'm an U.S. Citizen). I was wondering if there is any rules regarding dual citizenships between U.S. and HK/China...can she hold two passports at the same time? would U.S. embassy allow this?

    No problem. Your baby is allowed to hold both the HKSAR & USA passport. Both US and HK allow dual citizenship to some extent. Just bear in mind the liabilities associated with the US citizenship - your child will be subject to US tax in the future even if she never sets foot in the US. She will also have trouble opening brokerage / investment accounts in Hong Kong (if they know you are US citizen), as banks wouldn't go thru the trouble of fulfilling US regulatory requirements.

    All banks in Hong Kong are required to do the US regulatory requirement already. I'm a US citizen and got those accounts without any issues.

    The USA allows it, provided you obey the rules on being a US citizen, including:

    Filing taxes every year if income at certain (low) level. She won't owe taxes unless above a certain point but will need to file nonetheless.

    Filing a FBAR bank account disclosure if over a certain amount.

    Filing FATCA account disclosures if over a certain amount.

    Entering and exiting the USA only on their American passport.

    that is a common misperception.
    China does not allow dual nationality,
    regards foreign passports merely as paper wish, and the child as Chinese national.
