Dependent visa (Hong Kong) refugees status

    Hi There,

    Detriment, It's because he was caught working illegal last 2014.

    was sent to prison for 12months.

    We got Married 2016, All supporting documents is good, and my financial status is stable.

    They only said , they refused it's because he has criminal record by working illegal.

    We have submitted all documents to support the re-application.

    But haven't heard anything yet for the last 3 months, I was wondering if anyone knows a good lawyer, has knowledge about this kind of case.

    Because the first applications was only done by our self. Maybe, I missed something that better presented by lawyer??

    Look forward to hear good suggestion here.

    There are some trends here that said if u are refugee without a criminal records and you enter hk legally but you only over stay, if you apply for Depandant visa it will take almost 2years to be processed.

    @shri is it the same poster as before? Story and timeline seems to match. Same questions over and over...and over again.

    From the Visa Handbook: Dependent Visa


    15. In general, unless a person has the right of abode or right to land in the HKSAR, he/she requires a visa/entry permit to take up residence as dependant in the HKSAR. While each application is determined on its individual merits, an applicant should meet normal immigration requirements (such as holding a valid travel document with adequate returnability to his/her country of residence or citizenship; be of clear criminal record and raise no security or criminal concerns to the HKSAR; have no likelihood of becoming a burden on the HKSAR, etc.) as well as the relevant specific eligibility criteria detailed above before he/she may be considered for the grant of a visa/entry permit. It should be noted that the eligibility criteria may be subject to change from time to time without prior notice. Please check the Immigration Department’s website at www.immd.gov.hk for up-to-date information.


    One of the immigration advisor websites says that HK doesn't much investigate criminal records in other countries but since this was HK where he went to
    prison...well, it doesn't look like he is going to meet the criteria. Hope I am understanding the situation correctly...

    Thank you MABinPengChau, for response.

    I already knew this one, I have been busy learning more about it.

    My only question here is , anyone knew a good lawyer who could advise us or we can talk too, about our second application.

    I can answer all immigration requirements.

    My Husband, doesn't have deportation.

    But since, lawyer has different way of presenting documents, maybe there is possibilities.

    I spoke with one lawyer before, but there fees is way too much and they suggested, that I should fight and take the case onto the judiciary veiw. which is I don't wish to do, because I knew it will be more complicated and it will take more years.

    I just want to have lawyer which can represent and explain to immigration the situation.
