the entire PR + HKSAR Passport process was very smooth
the officer was nice and just said I am category 2 rather than 4. No questions at all
do you know whether there’s a difference in interpretation of Chinese nationality by HKSAR vs PRC government?
HKSAR allows Chinese nationals to hold foreign passports as travel documents but not entitled to consular services while in China incl HKSAR
does PRC government also interpret the same when it comes to the Home Return Permit application?

    much appreciated
Sounds like your home free because you are confirmed Chinese national via Hong Kong immigration documents : the guy even ticked the box for you as such : so you will get your home return permit via those papers I assume : no need to renounce Australian citizenship : good job overall

I'm wondering if anyone know the eligibility of my situation:

    - Born in China
    - Immigrated to Australia and became citizen decades ago
    - Worked and lived in HK for 7+ years and gotten HKPID and HKSAR Passport (with Chinese name printed on them)
    - Frequent traveller to China over past decade on visas obtained on my Australian passport

When filing out Application for Verification of Eligibility for Permanent Identity Card form, I initially checked box (4) Persons not of Chinese nationality, but the Immigration Tower 35F staff actually changed my form to category (2) Chinese citizens who have ordinarily resided in HK

Am I eligible for the HRP?
Which category will I fall under the HRP application (2 Chinese national or 4 Foreign national/no nationality)?
What documents do I need to present to CTS and do I declare that I have foreign passport?
Will I need to renounce/give up my Australian passport/citizenship?

Really appreciate any insight people can provide here. There has to be other members on this forum share similar background to mine (born in China > obtained foreign passport/citizenship > came to HK and gotten HK PR/Passport > gotten/attempted to get HRP)

    Thanks all!
did you have to rescind your AU passport?

This is the part of the Chinese Nationality Law that is specifically applied to HK and related to your case.

I am curious - did you renounce Chinese nationality when you took up Australian nationality?

Explanations of Some Questions by the Standing Committee of the National People’s Congress Concerning the Implementation of the Nationality Law of the People’s Republic of China in the Hong Kong Special Administrative Region

(Adopted at the 19th Session of the Standing Committee of the 8th National People’s Congress on 15 May 1996)

Where a Hong Kong resident is of Chinese descent and was born in the Chinese territories (including Hong Kong), or where a person satisfies the criteria laid down in the Nationality Law of the People’s Republic of China for having Chinese nationality, he is a Chinese national.

    @kma88

Was it you or someone else who pointed out in one of these threads that a Chinese born on mainland China automatically loses his Chinese nationality if he takes on another. Whereas this does not apply to
persons who have Chinese nationality + ROA in HK by descent.

Afaik that you will not automatically lose but you will be required to go through the process to cancel hukou registration etc which is a prerequisite for China passport travel to Hong Kong Macau exit entry card etc : the reason I say this is because China will not issue a China visa into your foreign passport to enter China if still holding hukou : I guess the original poster has got his China nationality back in a circular way because has Australia passport with China visa so cancelled hukou : then live in Hong Kong 7years and under Hong Kong is China national again : then can get hrp etc using Hong Kong papers so he got back what was lost moving to Australia

Hello, I am in the exact same situation. Australian born in China, also as a foreigner HKPID but forced to be a HKID because I was born in China. They said I had to prove to them that I gave up my Chinese nationality if I wanted to be classified as a foreigner (I think my parents did but I obviously dont have the documents).

I also am trying to get the HRP, am curious if you ended up getting it and if you faced any issues?

You can renounce your Chinese citizenship at any time by going to the Immigration Department in Hong Kong. Of course, once you do that you will no longer be eligible for the HRP.

hmm yeah it doesn't really matter to me that they classified me as a Chinese national. Probably for the better since I'm Chinese ethnicity. I'm more curious on how I can obtain the HRP.

google translate plug in works well enough to get the info if you dont read chinese. Input needs to be in chinese when it comes to application, so you might need to get a friend to send you the stuff in chinese to cut and paste (or do for you online)
