    ASSG/IANG Visa Extension Waiting

    Hello everyone,

    I submitted my assg/iang visa extension application and all my requested supporting documents. There is only 1 week left before my visa expires but they still haven't finalised my result. I have heard that since I am awaiting result, I don't need to leave HK upon expiry of current visa and that they will give me some time to leave in case of rejection.

    Is that true? I don't want to be considered illegally overstaying and getting deported. Also, I am working and there is a 1 month notice period of resignation as stated in my employment contract, so I can't just leave immediately in case they reject me. Please advise.

    It's a grey area where you will be technically overstaying but it's not enforced. It's not codified either way in the law.

    Yes you don't need to worry, not sure how grey it is, but been into same situation with no issues, even got confirmation from immigration that can continue to work.

    Immigration are so slow these days, took them two months to sort out my helper's visa. I even got a call from the director of immigration apologizing, they had lost the documents I submitted (three times), don't know what drug they're on but it's certainly not the productivity one!

    Go in to Immigration a few days before expiry. Did this for my helper’s visa renewal and they gave us the new visa on the day.
    I certainly wouldn’t risk overstaying your visa without at least getting told by Immigration that is what you should do.

    As for your employment, I expect there’s a clause in your contract saying you have to have a valid visa. So if you don’t then you’d probably be in breach of contract and your employment would end automatically without a notice period anyway. I would certainly give your employer the heads up that your visa hasn’t yet been renewed.

    Many beautiful options how to mess yourself and your job up and get immigration angry Definitely none from experience.
    OP just politely email them if you’re worried and they’ll return you a call.

    Thanks for all the advice but I just received an email from them saying that my submitted employment contract dated dec-22 is too old for them. Not sure how it's considered "not up to date" even though I didn't change jobs.... gonna call them again tomorrow. Why they make this routine process so difficult?

    Instead of calling them better submit latest payslips/bank statements to show employment is ongoing, and try to get supporting letter from employer.
    It actually was expected that you would provide either of this.

    Seen similar cases where the employees were advised to stay at home after the expiry date and wait for visa to be approved.
