    Dependent visa delay.

    Hello everyone, I married last year March, my wife is hong kong citizen. We summited our visa application on MAy last year. We received the acknowledgement letter and all the further requirements have been provided to the immigration. The last documents they ask was submitted December at their office in wan Chai by both me and my wife. I am African, I am overstay but also asylum seeker here. I over stay for over 2 years before I surrender to the immigration myself and took asylum. Until now the visa not yet approved, we call the case officer he was talking about overstay and all that. Last week I went to tuen muen and they gave me a paper that I will be going to appear in court, they charge me to court because of the overstay. I went to court on Monday 25th March, the case was adjourned till July again.
    Anyone with Idea about this whole process and possibly the outcome.
    I don't have any crime record in hk and my wife earn approximately 30k monthly.
    I don't know if anyone has seen this kind of case and how long is gonna take before the visa get approved.
    The visa status is still showing in progress.

    The whole thing will probably depend on whether you are found guilty in this pending court case.

    Yes, I have already go for the first court hearing on Saturday, I was ask to go after they mentioned my case and the immigration officer that was present told the judge that they want to adjourned it to July.
    So I don't know what the outcome is yet
    If they will approve visa first before the final court outcome or after the court outcome.

    I don't know if visa comes during the court case or after all the court case.

    2 years overstay and then Assylum seeker. Just the asylum seeker married to local part for dependent visa takes aprox 18 months but since you have court case for overstay. OMG you may be screwed

    I wouldnt get your hopes up too high.

    The overstayer will be involved in a lengthy Court proceeding
    The overstayer may eventually be removed or deported from Hong Kong

    I don't think so, have someone also same process and the visa was approved after. Every asylum seeker here have a case in the court, when you seek asylum when you are going for the process, some stage will have to go to hight court. Everyone with asylum here does that.
    But shatin court is the immigration take you there, that is where they will determine if have to same some penalties for the overstay or the case be waived.
    Since you are married here, nothing like removal from hk

    So after two years in HK suddenly decide to seek asylum? Is that correct?

    What ever you do, do not say "DELAY NO MORE" to any court judge, you will get the book thrown at you. DELAY NO MORE = GO F@@K YOUR MOTHER in English. Dont listen to Hkemail888 he/she just wants to get you into more trouble.

    Actually I am not going to say that ok
    Will only discuss that with the lawyer that will represent me
    Is better to say you are guilty of the charge and face the Penalty which may be few month in cic detention
    And tell the lawyer that I don't want further adjournment that I want to plead guilty once and for all.
