Village flat neighbour refusing to pay their share

    Hi

I'm staying in a 3-storey village flat located in Tai Po, where each floor is occupied by a different household. The sewer here is connected to a self-managed underground septic tank, and recently it had to be pumped out. One of the households refuses to pay their share ($800), leaving me out of pocket!

Does anyone know how I could recover the money? Should I hire a solicitor to recover the charge? This is going to be an recurring expense, so I'm trying to avoid the hassle of taking them to court each and every time.

    Any thought appreciated.

    Small Claims Tribunal.

Small fee upfront, no need for solicitors.

Yeah, but the Small Claims Tribunal would only award the amount claimed - probably along with some negligible fees. It wouldn't effectively deter them from reoffending again, right? I'd be the one who'll have the most to lose if I need to take them to court every time.

Surely this is the landlord's cost?

$2400 seems awfully expensive for pumping out a village house septic tank.

I actually own the place now. It's the second time already.

Apply for enforcement with the Bailiff Section.

Give them an offer they can't refuse. Send them a 'little message'.

What does the other owner say about the matter? Has the non-payer always been a non-payer?

if you are the landlord and it is not mentioned in the lease (like rent and rates) it is entirely landlords cost.

if fee was 2,400 you overpaid, get quotes from other companies, should be nearer 900 unless there are special conditions.

I do sympathise new arrivals in NT dont know about the sewerage pumping charges.

    emx and rickyross like this.

Unfortunately, I'm the owner of the ground floor - I've only recently bought it. They paid the first bill, but not the second or third.
