    Still don't understand why your landlord has keys to your flat. Who does that?

    Anyway, you only can take it to the Smalls Claims if your LL doesn't return the deposit within seven days from the end of the lease. You then have to lodge the claim, get a date and appear at the tribunal. You'll be long gone I would imagine.

    I wonder, what legal rights does he have though?

    Can he evict me? I don’t want to change the locks etc, if he can rock up with the police and tell me to get out? I would think that he would need to get a court order to evict me, is that right? How long would that take?

    Also, is it legal for me to use my bond as last 2 months rent?

    He can evict you but he has to go through the courts and provide enough documents/proof for the judge to grant him the flat back, he cant just turn up and tell you to bugger off. It will also take him sometime to do that (dont know exactly how long, never had it done to me ).

    using the last 2 months is technically not legal but some people do it some dont. You do need to inform the landlord that you will use the deposit as last 2 months rents and see what they say.

    HI!,

    So its 100% he has to go to court first? he cant just hire an agency or get the police?

    I just want to be sure, as I feel he might come over in the next day or two and wanted to be sure of my rights and what he has the power to do!

    Go to the below website, its from 2006 but its got a lot of information and most of its still valid. It can take the landlord 192 days to evict you after going through legal procedures, also It is a criminal offense to harass and illegally evict tenants and sub-tenants. Tenancy contracts usually contain a clause that prohibits the tenant from subletting the property to another party. Any subletting by the tenant will be a breach and the landlord can institute legal action for compensation.

    I think better put in writing, the termination of the contract and the 2 months deposit will be used for the remaining two months. Keep copy and send it by registered mail just in case he asked for monthly rent. Then you can show to him the copy of the letter w/the registered slip.
