    Break Clause

    Hi,

    My tenancy contract is for 2 years with the option to break clause after completion of 12 months. If I renegotiate the rental rates with my landlord after 12 months, does any one know if this constitutes a new agreement and hence I would not be able to subsequently break clause, ie I am bound to stay with the new rental rates for the whole of the second year? Thanks.

    It is whatever you to agree with in writing. I have renegotiated many times and each time had a new contract drawn up (direct with the landlord and bypassing the real estate agent). You will need to agree on the duration under the new rent.

    As discobay says - within the broad legal framework you can negotiate whatever you want with the landlord. Make sure you get the agreement in writing.
