Devil's in the detail and there's a lot of detail we don't know yet. What did Pecker testify to in his conversation with Trump? Did Trump leave any written instructions to Cohen that will surface in discovery? My guess is that intent is going to be a walk in the park for Bragg and that Bragg wouldn't be doing this if he didn't already have intent nailed down in his evidence trove.
