"Your honor, may it please the court to learn that my client was desperately trying to save his marriage with these illegal payoffs."

I guess there might be another "billionaire" in the jury pool who will sympathize.

Well, it isn't a question of morality.... it's about proving the intent that paying her off was to help his election chances rather than save his marriage. How does the Bragg manage to say he knows what Trump's intention was better than Trump?

It seems a pretty flimsy case to me, much as I think Trump is a scumbag who has lied, cheated and stolen his way through life and deserves to end up behind bars.

Devil's in the detail and there's a lot of detail we don't know yet. What did Pecker testify to in his conversation with Trump? Did Trump leave any written instructions to Cohen that will surface in discovery? My guess is that intent is going to be a walk in the park for Bragg and that Bragg wouldn't be doing this if he didn't already have intent nailed down in his evidence trove.

It is pretty hard to see how it can be nailed down. Maybe the best Bragg has to offer would be testimony from Cohen, who has no credibility at all. Highly unlikely there is a written document saying "please pay off Stormy Daniels so it doesn't hurt my election campaign". What kind of evidence do you think he could have to make this a walk in the park?

If Cohen was also in jeopardy at this point, I can see him being labeled as not credible. It appears this guy is also flipping on Trump:

Paragraph 19 in the statement of facts is fairly revealing about motive -- and it's not to keep Melania happy.

Nothing from Trump. It’s all his convicted felon and verified liar Cohen.

Perhaps he is the teflon Don in this case.

The other grand jury cases may have firmer grounds with the phone call recording in Georgia and the security camera footage in the looted top secret document case.

Yeah, the other investigations are far more serious for him.

    Yes

Also plausible deniability would seem a valid approach
