s.71 of the District Council ordinance gives District councils the right to establish committees. The debate seems to be whether or not constitutional affairs are "matters affecting the well-being of the people in the District". The HAD obviously says they aren't. Google didn't yield any results on how the District Council Secretariat is established, so I assume it's just a part of the HAD and the government can do pretty much whatever they like with it.
