    I rented a brand new apartment through an agent. That building is only 6 years old. It could be possible that the problem occurred during my stay and I didn't realize because I wasn't using it. But I don't want to entertain this claim as this came after I handed over the keys

    how much are they asking to deduct, what appliance was it that was broken??

    Most landlords wont agree to terms like that. They have the advantage by holding the damage deposit as long as possible. Why take the risk of you damaging the flat when you move out.

    The best way is to only give keys back once you receive payment in full (transfer or cash). Do not give keys back unless it is cleared. Once the keys are returned, you will have little to no leverage meaning youll have to go thru hurdles and/or at the mercy of the landlord.

    If landlord plays games during repossession, you keep the keys and you keep the flat. Make the landlord evict you instead.

    How much is the deposit?

    Did you and your landlord sign a handback document on the date you delivered the keys to the landlord? If no, you need to write a detailed statement of claims for submission to the court stating the landlord had accepted all finishes, fixtures and non-fixtures of the property were satisfactory and therefore, security deposit was returned to you without deduction.

    It was working till October last year, then I was out of Hong Kong for 6 Months. Didn't use after returning since it was summers already.

    HK$31,000 is the deposit.

    No document was signed but the landlord signed the cheque in reception area of my building, covered by security cameras. Also, the cheque has bounced once.

    No sensible landlord will return the deposit until after the tenant has moved out and they have done an inspection.
